Common use of Interim Capital Transaction Clause in Contracts

Interim Capital Transaction. A transaction pursuant to which the --------------------------- Partnership borrows funds or refinances existing debt, a sale, condemnation, exchange, abandonment or other disposition of a portion (which is less than substantially all) of the assets of the Partnership, an insurance recovery and any other transaction, other than a Terminating Capital Transaction, that, in accordance with generally accepted accounting principles, is considered capital in nature.
