INTERMODAL FUEL SURCHARGE Clause Samples
The Intermodal Fuel Surcharge clause establishes a mechanism for adjusting transportation charges based on fluctuations in fuel costs associated with intermodal shipping services. Typically, this clause outlines how surcharges are calculated, such as referencing a published fuel price index and applying a percentage or fixed fee to freight invoices when fuel prices exceed a certain threshold. Its core practical function is to allocate the risk of volatile fuel prices between the contracting parties, ensuring that carriers can recover increased fuel expenses while providing transparency and predictability for shippers.
INTERMODAL FUEL SURCHARGE. Unless we have agreed otherwise in a written agreement signed by our authorized representative, we assess a fuel surcharge on transportation rates (as well as accessorial charges for stop-offs, reconsignments, redeliveries, equipment ordered not used and other charges involving actual tractor or train movement or mileage) based on the following matrix. This fuel surcharge matrix is based on the DOE's National Average Diesel Fuel Index published by the Energy Information Administration every Monday. Revisions to this surcharge will occur the day after the DOE posts its weekly fuel index. The index is available on the Internet at ▇▇▇.▇▇▇.▇▇▇.▇▇▇. The fuel surcharge will increase in 0.5% increments for every $0.04 increase in the DOE index should it exceed the table below.
