INTERNET DATA CENTER SERVICES. Subject to the terms and conditions of this Agreement, during the term of this Agreement, Exodus will provide to Customer the services described in the Internet Data Center Services Order Form(s) ("IDC Services Order Form(s)") accepted by Exodus, or substantially similar services if such substantially similar services would provide Customer with substantially similar benefits ("Internet Data Center Services"). All IDC Services Order Forms accepted by Exodus are incorporated herein by this reference, each as of the Submission Date indicated in such form.

INTERNET DATA CENTER SERVICES. Subject to the terms and conditions of this Agreement, including but not limited to Customer's timely payment to Exodus of all fees specified in this Agreement and Customer's compliance with the Rules arid Regulations, Exodus will provide to Customer the Internet Data Center Services.
INTERNET DATA CENTER SERVICES. 1.1 Subject to the terms and conditions of this Agreement, during the term of this Agreement, Exodus will provide to Customer the services described in the Internet Data Center Services Order Forms(s) ("Initial IDC Services Order Form(s)") attached hereto as Exhibit A, the product specifications attached hereto as Exhibit B (the "Product Specifications") and the Statement of Work attached hereto as Exhibit C (the "SOW") (such services, the "Internet Data Center Services"). Any future IDC Services Order Forms accepted by Exodus are incorporated herein by this reference, each as of the Submission Date indicated in such form. 1.2 Exodus will notify Customer prior to assigning or transferring any key personnel to or from Customer's account. 1.3 The Customer site at Exodus' Irvine Internet Data Center will be operational in beta test mode on April 1, 1999. For purposes of this Agreement, beta test mode shall mean that the facilities aspects of the Internet Data Center Services, including racks, bandwidth, and space, will be available but that the Internet Data Center Services will be subject to periodic intervals of non-operation in order for modifications to be made. Both parties will use best efforts to have the Irvine site operational and accessible in conformance with the service level warranty set forth in Section 5.2 by April 1, 1999, but in no event later than May 1, 1999 (the "Operational Date"). The Customer site at Exodus' Hernxxx Xxxernet Data Center will be operational and accessible in conformance with the service level warranty set forth in Section 5.2 within sixty (60) days of the Operational Date of the Irvine Data Center.
INTERNET DATA CENTER SERVICES. Subject to the terms and conditions of this Agreement during the term of this Agreement, Exodus will provide to Customer the services described in the Internet Data Center Services Order Form(s) ("IDC Services Order Form(s)") accepted by Exodus ("Internet Data Center Services"). All IDC Services Order Forms accepted by Exodus are incorporated herein by this reference, each as of the Submission Date indicated in such form. The initial IDC Services Order Form is set forth in Exhibit A. The parties hereby agree that the service descriptions attached hereto as Exhibit B are hereby incorporated into the initial IDC Services Form and thereby, into this Agreement. During the term of this Agreement, Exodus shall provide support services in accordance with Exhibit C. Exodus may modify its support procedures and Internet Data Center Services during the term of this Agreement, provided that such changes do not materially diminish the benefits afforded to Customer pursuant to Exhibit C.

  • Internet Services Transfer Agent shall make available to Fund and Shareholders, through its web sites, including but not limited to xxx.xxxxxxxxxxxxx.xxx (collectively, “Web Site”), online access to certain Account and Shareholder information and certain transaction capabilities (“Internet Services”), subject to Transfer Agent’s security procedures and the terms and conditions set forth herein and on the Web Site. Transfer Agent provides Internet Services “as is,” on an “as available” basis, and hereby specifically disclaims any and all representations or warranties, express or implied, regarding such Internet Services, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Transfer Agent shall at all times use reasonable care in performing Internet Services under this Agreement.

  • Call Center Services Answer telephone inquiries during mutually agreed upon hours each day on which the Fund is open for trading. In the event that the Fund plans to be open on a business day when the New York Stock Exchange is to be closed, the Fund shall provide the Transfer Agent with reasonable advance notice and the parties shall discuss the call center resources available for such day. The Transfer Agent shall answer and respond to inquiries from existing Shareholders, prospective Shareholders of the Fund and broker-dealers on behalf of such Shareholders in accordance with the instructions provided by the Fund to the Transfer Agent for purpose of fulfilling its duties under this Agreement, including, accepting transaction requests on behalf of the Fund.

  • Web Services Our Web Services are designed to enable you to easily establish a presence on the Internet. Our Web Hosting and Design is composed of our Web Hosting and Design Publishing Component and other miscellaneous components. These components may be used independently or in conjunction with each other.

  • Online Services Microsoft warrants that each Online Service will perform in accordance with the applicable SLA during Customer’s use. Customer’s remedies for breach of this warranty are described in the SLA.

  • Hosting Services 13.1 If Supplier or its subcontractor, affiliate or any other person or entity providing products or services under the Contract Hosts Customer Data in connection with an Acquisition, the provisions of Appendix 1, attached hereto and incorporated herein, apply to such Acquisition. 13.2 If the Hosting of Customer Data by Supplier or its subcontractor, affiliate or any other person or entity providing products or services under the Contract contributes to or directly causes a Data Breach, Supplier shall be responsible for the obligations set forth in Appendix 1 related to breach reporting requirements and associated costs. Likewise if such Hosting contributes to or directly causes a Security Incident, Supplier shall be responsible for the obligations set forth in Appendix 1, as applicable. 14 Change Management

  • Voice Services In lieu of any other rates and discounts, Customer will pay fixed per-minute rates ranging from $0.000 to $0.000 for the following Voice Services: Domestic Voice Service: Domestic Outbound Voice Service, including Calling Card and Domestic Inbound Voice Service based on origination and termination type. Data Services:

  • Customer Services Customer Relationship Management (CRM): All aspects of the CRM process, including planning, scheduling, and control activities involved with service delivery. The service components facilitate agencies’ requirements for managing and coordinating customer interactions across multiple communication channels and business lines. Customer Preferences: Customizing customer preferences relative to interface requirements and information delivery mechanisms (e.g., personalization, subscriptions, alerts and notifications).

  • Surgery Services This plan covers surgery services to treat a disease or injury when: • the operation is not experimental or investigational, or cosmetic in nature; • the operation is being performed at the appropriate place of service; and • the physician is licensed to perform the surgery. This plan covers reconstructive surgery and procedures when the services are performed to relieve pain, or to correct or improve bodily function that is impaired as a result of: • a birth defect; • an accidental injury; • a disease; or • a previous covered surgical procedure. Functional indications for surgical correction do not include psychological, psychiatric or emotional reasons. This plan covers the procedures listed below to treat functional impairments. • abdominal wall surgery including panniculectomy (other than an abdominoplasty); • blepharoplasty and ptosis repair; • gastric bypass or gastric banding; • nasal reconstruction and septorhinoplasty; • orthognathic surgery including mandibular and maxillary osteotomy; • reduction mammoplasty; • removal of breast implants; • removal or treatment of proliferative vascular lesions and hemangiomas; • treatment of varicose veins; or • gynecomastia.

  • Provider Services Charges for the following Services when ordered by a Physician for the treatment of an Injury or Illness.

  • Internet Service In the event that internet is required during your stay, please verify that the Property selected provides the service. Rules of the House: In the event there are rules specific to your Property either required by the Owner or if applicable from an HOA, they will be posted at the home and your compliance is necessary. Rental Unit for Sale: Occasionally a Property may go on the market for sale. In such cases Agent reserves the right to show the Property to potential buyers. Agent will make every effort to schedule the showing at a time that is convenient for Tenant, so as not to interrupt your vacation. Tenant’s cooperation is appreciated. Consumable Products: Paper products, laundry/dish detergent, personal toiletry items and food staples are not included in the Properties. Linens: Linens are included with all Properties for reservations up to 2 days or more. If linens and towels are damaged or missing there will be an added fee to replace and/or clean those items. Linens and towels should only be used for sleeping in and drying off. Damaged or missing bath towels are $25, hand towels are $15, wash cloths are $10, sheets are $30, pillow cases are $15, and bath mats are $20. Damaged items might include makeup, blood stains, excessive dirt, tanning lotion, and human waste.
