Common use of Internet Product Warnings Clause in Contracts

Internet Product Warnings. In the event Scentco sells Products that do not qualify as Reformulated Products via the internet to customers located in California, the warning requirements of this Section shall be satisfied if, prior to purchase: (a) one of the foregoing warnings, described in Section 2.2, appears on the same page, in the same type size or larger than the Product description text, as the Product; (b) a warning appears on the same web page as the price for the Product, in the same type size or larger than the Product description text; (c) a warning appears on one or more web pages displayed to the consumer prior to purchase, in the same type size or larger than the Product description text; or (d) a hyperlink, clearly marked “WARNING,” appears on the Product display page, in type large enough so that the consumer does not have to search for it, and a prominently placed warning appears elsewhere, such as on the Product description page, in a manner that clearly associates it with the Product to which the warning applies, prior to checkout or purchase.

In If the event Scentco sells Products that do are not qualify as Reformulated Products as defined herein, if Trademark Global distributes, sells, or otherwise offers for sale such Products via the its internet website to customers located in California, the warning requirements of this Section section shall be satisfied ifif the foregoing warning or a clearly marked hyperlink to the warning is prominently displayed to customers, prior to purchasepurchase and in a manner such that the consumer does not have to seek out the information being provided, using the word “WARNING” and appearing on: (a) one of the foregoing warnings, described in Section 2.2, appears same web page on which the Product is displayed; (b) the same web page as the order form for the Product; (c) on the same pagepage as the price for any Product; or (d) on one or more web pages displayed to a purchaser during the checkout process. The warning shall appear in any of the above instances adjacent to or immediately following the display, description or price of the Product for which it is given in the same type size or larger than the Product description text, as the Product; (b) a warning appears on the same web page as the price other consumer information provided for the Product, in the same type size or larger than the Product description text; (c) a warning appears on one or more web pages displayed to the consumer prior to purchase, in the same type size or larger than the Product description text; or (d) a hyperlink, clearly marked “WARNING,” appears on the Product display page, in type large enough so that the consumer does not have to search for it, and a prominently placed warning appears elsewhere, such as on the Product description page, in a manner that clearly associates it with the Product to which the warning applies, prior to checkout or purchase.
