INTERPRETATION OF DOCUMENT. Should a Bidder find discrepancies in, or omissions from, the specifications, or should he be in doubt as to their meaning, they shall, at once, notify the Operations Manager and if the point in question is not clearly and fully set forth, a written addendum or bulletin of instructions will be mailed or delivered to each person. Each person requesting an interpretation will be responsible for the delivery of his request to the Operations Manager. Ketchikan Public Utilities will not be bound by, nor responsible for, any other explanations or interpretations of the proposed documents other than those given in writing as set forth in this paragraph. Oral instruction, interpretations, or representation shall not be binding upon the Owner.
INTERPRETATION OF DOCUMENT. The parties hereto acknowledge and agree that this Agreement has been negotiated at arms' length and between parties equally sophisticated and knowledgeable in the matters dealt with in this Agreement. Each party has had access to counsel of their selection. Accordingly, any rule of law, court decision or other legal precedent that would require interpretation of any ambiguities in this Agreement against the party that has drafted it is not applicable and is waived.
