INTERRUPTION OR REDUCTION OF DELIVERIES. 3.1 ANAHEIM shall not be obligated to accept or pay for and may, without any penalty to ANAHEIM, require CUSTOMER to interrupt or reduce deliveries of available energy from the Generating Facility (a) when necessary in order to construct, install, maintain, repair, replace, remove, investigate, or inspect any of ANAHEIM’s equipment or part of its system; (b) if ANAHEIM determines in its sole discretion that curtailment, interruption, or reduction is necessary because of emergencies, forced or scheduled outages, force majeure, or compliance with prudent electrical practices; or (c) when CUSTOMER fails to operate the Generating Facility in conformance with applicable municipal, state, and federal law, including, but not limited to the ANAHEIM Charter and Municipal Code, the ANAHEIM Electric Rates, Rules and Regulations, and the Guidelines for Interconnection of Customer Generators on file with ANAHEIM and incorporated herein by reference (collectively, “ANAHEIM Rules and Regulations”). 3.2 Whenever reasonably possible, ANAHEIM will give CUSTOMER reasonable notice of the possibility that interruption or reduction of deliveries may be required. 3.3 Notwithstanding any other provision of this Agreement, if at any time ANAHEIM, in its sole discretion, determines that either (a) the Generating Facility, or its operation, may endanger ANAHEIM personnel or any person; or (b) the continued operation of the Generating Facility may endanger ANAHEIM’s electric system, the environment, or any property, ANAHEIM may disconnect the Generating Facility from ANAHEIM’s system. The Generating Facility shall remain disconnected until such time as ANAHEIM determines that the condition(s) referenced in (a) or (b) of this Section 3.3 have been corrected to ANAHEIM’s satisfaction.

INTERRUPTION OR REDUCTION OF DELIVERIES. 3.1 ANAHEIM a. COCS Authority. COCS shall not be obligated to accept or pay for produced energy from a Facility larger than 20 kW unless a separate agreement has been entered into between the Customer and mayCOCS. At any time, without any penalty to ANAHEIM, COCS may require CUSTOMER the Customer to interrupt or reduce deliveries of available energy from in the Generating Facility following instances:
(a1) when When COCS determines that it is necessary in order to construct, install, maintain, repair, replace, remove, investigate, or inspect investigate any of ANAHEIM’s COCS equipment or of any part of its system; Electric Utility System;
(b2) if ANAHEIM If COCS determines in its sole discretion that curtailment, interruption, or reduction is necessary because of emergencies, forced or scheduled outages, force majeure, or compliance with prudent electrical practices; or ;
(c3) when CUSTOMER fails to operate the Generating Facility in conformance with applicable municipal, state, and federal law, including, but not limited to the ANAHEIM Charter and Municipal Code, the ANAHEIM Electric Rates, Rules and Regulations, and the Guidelines for Interconnection of Customer Generators on file with ANAHEIM and incorporated herein by reference (collectively, “ANAHEIM Rules and Regulations”).
3.2 Whenever reasonably possible, ANAHEIM will give CUSTOMER reasonable notice of the possibility that interruption or reduction of deliveries may be required.
3.3 Notwithstanding any other provision of this Agreement, COCS shall have the right to disconnect the Facility from the Electric Utility System if at any time ANAHEIM, in its sole discretion, it determines that either either: (a) the Generating Facility, Facility or its operation, operation may endanger ANAHEIM personnel or any person; COCS personnel, or (b) the continued operation of the Generating Facility may endanger ANAHEIM’s electric system, the environment, or any property, ANAHEIM may disconnect integrity of the Generating Facility from ANAHEIM’s systemElectric Utility System. The Generating Facility shall remain disconnected until such time as ANAHEIM determines COCS is satisfied that the condition(s) referenced in (a) or (b) of this Section 3.3 objectionable conditions have been corrected or no longer exists; or
(4) COCS discovers or learns of the Facility manufacturer defects or deficiencies that may have adverse operational impacts on the Electric Utility System.
b. Customer and COCS clearly understand and agree that COCS will not accept nor assume any liability for interrupting the interconnection between the Facility and the Electric Utility System. COCS is authorized to, but not liable for any effects of opening up and padlocking open the Customer’s external disconnect switch, disconnecting the Facility at the Electric Utility System’s Points of Interconnection or taking any other action that physically separates or isolates the Facility from the Electric Utility System. COCS will attempt to ANAHEIM’s satisfactionprovide sufficient Customer notice prior to interconnection disconnection, but Customer notice is not necessary for immediate Facility isolation should a condition warrant immediate interconnection disconnection as determined by COCS.

3.3 Notwithstanding any other provision of this Agreement, if at Cooperative shall have the right to disconnect any time ANAHEIM, connection between the Customer Facility and Cooperative’s facilities pursuant to this Agreement in its sole discretion, determines that either (the event of: a) emergencies, b) fire or threat of fire, including but not limited to wildfires, b) imminent hazard or threat to any persons or property (including but not limited to Cooperative’s facilities), c) equipment/facility malfunctions, d) maintenance or repair of Cooperative’s facilities, e) the Generating Customer Facility, or its operation, may endanger ANAHEIM personnel operation or any person; condition thereof, is in violation of this Agreement or (b) materially endangers, injures, impairs or otherwise interferes with the continued integrity or operation of Cooperative’s facilities, f) Customer prohibits or materially impairs or otherwise interferes with Cooperative’s right of inspection of the Generating Facility may endanger ANAHEIM’s electric system, the environmentCustomer Facility, or any propertyportion thereof, ANAHEIM under this Agreement, or g) Customer’s violation of any term or condition of this Agreement.
