Common use of Intervention by Trustee Clause in Contracts

Intervention by Trustee. In any judicial proceeding to which the Authority is a party and which in the opinion of the Trustee has a substantial bearing on the interests of the Owners of the Bonds, the Trustee may, in the Trustee’s own name, intervene on behalf of the Owners and will, upon receipt of indemnity satisfactory to it, do so if requested in writing by the Owners of at least 25 percent in aggregate principal amount of Bonds then Outstanding, if permitted by the court having jurisdiction.

Intervention by Trustee. In any judicial proceeding to which the Authority is a party and which in the opinion of the Trustee and its counsel has a substantial bearing on the interests of the Owners holders of the BondsBonds issued hereunder, the Trustee may, in the Trustee’s own name, may intervene on behalf of the Owners Bondholders and will, upon receipt of indemnity satisfactory to it, shall do so if requested in writing by the Owners holders of at least 25 percent in a majority of the aggregate principal amount of Bonds then Outstanding, if permitted by outstanding hereunder. The rights and obligations of the Trustee under this Section 11.4 are subject to the approval of the court having jurisdictionjurisdiction in the premises.

In any judicial proceeding to which the Authority Agency is a party and which which, in the opinion of the Trustee and its counsel, has a substantial bearing on the interests inter- ests of the Owners of any of the Bonds, the Trustee may, in the Trustee’s own name, may intervene on behalf of the Owners such Bond Owners, and willsubject to Section 8.02(l) hereof, upon receipt of indemnity satisfactory to it, shall do so if requested in writing by the Owners of at least 25 twenty-five percent in aggregate principal amount (25%) of Bonds then Outstanding, if permitted by the court having jurisdictionBonds.

In any judicial proceeding to which the Authority Agency is a party and which that, in the opinion of the Trustee and its counsel, has a substantial bearing on the interests of the Owners of any of the BondsBonds hereunder, the Trustee may, in the Trustee’s own name, may intervene on behalf of the Owners such Bond Owners, and willsubject to Section 7.02(c), upon receipt of indemnity satisfactory to it, shall do so if requested in writing by the Owners of at least 25 percent 25% in aggregate principal amount of such Bonds then Outstanding, if permitted by the court having jurisdiction.

In The Trustee may intervene on behalf of the Bondholders in any judicial proceeding to which the Authority is a party and which which, in the opinion of the Trustee and its counsel, has a substantial bearing on the interests of the Owners of the BondsBondholders, the Trustee may, in the Trustee’s own name, and shall intervene on behalf of the Owners and will, upon receipt of indemnity satisfactory to it, do so if it is requested in writing by the Owners holders of at least 25 percent 25% in aggregate requested principal amount of the Bonds then Outstanding, if permitted by Outstanding and is provided indemnity pursuant to Section 1002. The rights and obligations of the Trustee under this Section 1016 are subject to the approval of a court having of competent jurisdiction.
