Iran Divestment. By entering into this Agreement, Provider certifies that it is not on the "Entities Determined To Be Non-Responsive Bidders/Offerers Pursuant to The New York State Iran Divestment Act of 2012" list ("Prohibited Entities List") posted on the New York Office of General Services website at: xxxx://xxx.xxx.xx.xxx/about/regs/docs/ListofEntities.pdf and further certifies that in the performance of this Agreement, it will not utilize any subcontractor that is identified on the Prohibited Entities List. Provider agrees that should it seek to renew or extend this Agreement, it must provide the same certification at the time of renewal or extension. Provider also agrees that any proposed Assignee of the Agreement will be required to certify that it is not on the Prohibited Entities List before Purchaser may approve any request for assignment of this Agreement. During the term of the Agreement, should Purchaser receive information that a person (as defined in State Finance Law §165-a) is in violation of the above-referenced certifications, Purchaser will review such information and offer the person an opportunity to respond. If the person fails to demonstrate that it has ceased its engagement in the investment activity which is in violation of the Act within 90 days after the determination of such violation, then Purchaser shall take such action as may be appropriate and provided for by law, rule, or contract, including, but not limited to, seeking compliance, recovering damages, or declaring the Provider in default. Purchaser reserves the right to reject any request for renewal, extension, or assignment for an entity that appears on the Prohibited Entities List prior to the renewal, extension, or assignment of this Agreement, and to pursue a responsibility review with Provider should it appear on the Prohibited Entities List hereafter. (Note – this clause may be different for municipalities or other authorized users.)
Iran Divestment. The ESCO certifies that it is not identified on a list created by the North Carolina State Treasurer pursuant to N.C. Gen. Stat. §147-86.58 as a company engaging in investment activities in Iran. Contractor further certifies that in the performance of this Agreement it shall not use any contractor or subcontractor that is identified on such a list.
Iran Divestment. 8.9.1 By signing this agreement, Testing and Inspection Consultant certifies that as of the date of execution of this Agreement: 1) It does not appear on the Final Divestment List created by the North Carolina State Treasurer pursuant to N.C.G.S. 143-6A-4 and published on the State Treasurer's website at xxx.xxxxxxxxxxx.xxx/Xxxx and 2) It will not utilize any subcontractor that appears on the Final Divestment List in the performance of duties under this Agreement.
Iran Divestment. As of the date of this Contract, Contractor certifies that it is not identified on a list created by the North Carolina State Treasurer pursuant to N.C. Gen. Stat. §147-86.58 as a person engaging in investment activities in Iran. Contractor further certifies that in the performance of this Contract it shall not use any contractor or subcontractor that is identified on such a list.
Iran Divestment. The Iran Divestment Act of 2012, effective April 12, 2012, is codified at State Finance Law (“SFL”) Section 165-a and General Municipal Law (“GML”) Section 103-g. The Iran Divestment Act, with certain exceptions, prohibits the City of New York from entering into contracts with persons engaged in investment activities in the energy sector of Iran. Each bidder is required to certify at the time it submits its bid that it is not on a list of entities engaged in energy sector investment activities in Iran created by the Commissioner of the New York State Office of General Services pursuant to State Finance Law. Bidders are required to complete the attached certification and return it with its bid. The Iran Divestment Rider and Certification is included as Attachment A to the Agreement (SECTION III).
Iran Divestment. The Contractor hereby certifies that as of the date listed below, it is not on the Final Divestment List as created by the state Treasurer pursuant to NCGS § 143C-6A-4. In compliance with the requirements of the Iran Divestment Act and NCGS § 143C-6A-5(b), Contractor shall not utilize in the performance of the contract any subcontractor that is identified on the Finance Divestment List.
Iran Divestment. 27.01 Any vendor hired by the City to perform work related to this agreement shall comply with the requirements of the Iran Divestment Act by certifying that 1) it does not appear on the Final Divestment List created by the North Carolina State Treasurer pursuant to N.C.G.S. 143-6A-4 and published on the State Treasurer's website at xxx.xxxxxxxxxxx.xxx/Xxxx and 2) it will not utilize any subcontractor that appears on the Final Divestment List in the performance of duties under this Agreement.
Iran Divestment. By signing this agreement, Town certifies that as of the date of execution, receipt, or submission they are not listed on the Final Divestment List created by the NC Office of State Treasurer pursuant to NCGS 147 Article 6E, Iran Divestment Act, Iran Divestment Act Certification. Town shall not utilize any subcontractor that is identified on the Final Divestment List. Any organization defined under NCGS 147-86.80(2), Divestment from Companies Boycotting Israel, shall not engage in business totaling more than $1,000 with any company/business, etc. that boycotts Israel. A list of companies that boycott Israel is maintained by the NC Office of State Treasurer, pursuant to NCGS 147-86.81(a)(1). Any company listed as boycotting Israel is not eligible to do business with any State agency or political subdivision of the State.
Iran Divestment. Pursuant to Article 6E of Chapter 147 of the North Carolina General Statutes, County must require most entities with which it contracts, which would include Contractor under this Agreement, to certify that the entity is not identified on a list created by the State Treasurer pursuant to N.C.G.S. § 147-86.58 (the “Final Divestment List”). This requirement is related to ensuring that entities with which local governments contract are not involved in investment activities in Iran. Contractor certifies that: (i) it is not listed on the Final Divestment List, and (ii) it will not utilize any subcontractor performing work under this Agreement which is listed on the Final Divestment List.
Iran Divestment. 10-10.1 By signing this agreement, Consultant certifies that as of the date of execution of this Agreement
