Common use of Islamic/Swap – free accounts Clause in Contracts

Islamic/Swap – free accounts. 62.1. We offer the possibility to open Islamic (Swap-free) Accounts with us. Swap-free trading accounts are available only to those clients who cannot use swaps owing to their religious beliefs. Accordingly, in all instances where a request for an Islamic (Swap-free) Account is filed with us, we reserve the right to require an adequate justification for and/or proof of the necessity or need of any such conversion. Furthermore, we reserve the right to refuse the processing of any such request for any reason whatsoever, without being obliged to provide any explanation or justification. While a client may file a request for an Islamic (Swap-free) trading account at any time, the filing of any such request entails that all of such client’s other real trading Accounts with us will be converted into Swap-free trading accounts also, without any further notice being required. Conversion of a real trading Account to a Swap-free trading account is performed only upon the request and consent of those clients who complete and submit a request for an Islamic (Swap-free) Account. Upon the receipt of such a duly signed and executed request, we shall evaluate request and any ancillary documentation submitted to us and shall inform the client who equested the conversion by e-mail whether the request is accepted or not. 62.2. Clients are not allowed to use Swap-free Accounts to make profits from Swaps and may not request the payment of any Swap amounts that have been lost as a result of converting their real trading Account(s) into one or more Swap-free Account(s) for the period during which their real trading Account(s) has/have been converted into one or more Swap-free account(s). 62.3. We reserve the right to revoke the Swap-free status granted to any real trading Account at any time without being obliged to provide any explanation or justification. Furthermore, in the event that we detect any form of abuse, fraud, manipulation, cash-back arbitrage, carry trades, or other forms of deceitful or fraudulent activity in regard to any Swap-free Account of any client, we reserve the right, at any time, (a) with immediate effect, to revoke the Swap-free status from any and all real trading Accounts of such client that have been converted to a Swap-free trading Account; (b) to correct and recover any un- accrued Swaps and any related un-accrued interest expenses and/or costs pertaining to any and all of such client’s Swap-free trading Accounts during the period for which such Accounts were converted into Swap-free trading Accounts; and/or (c), with immediate effect, to close all trading Accounts of such client with us, nullify all trades carried out in such client’s trading Accounts with us and cancel and all profits or losses garnered in such client’s trading Accounts with us.

Furthermore, in the event that we detect any form of abuse, fraud, manipulation, cash-cash- back arbitrage, carry trades, or other forms of deceitful or fraudulent activity in regard to any Swap-free Account of any client, we reserve the right, at any time, (a) with immediate effect, to revoke the Swap-free status from any and all real trading Accounts of such client that have been converted to a Swap-free trading Account; (b) to correct and recover any un- accrued Swaps and any related un-accrued interest expenses and/or and or costs pertaining to any and all of such client’s Swap-free trading Accounts during the period for which such Accounts were converted into Swap-free trading Accounts; and/or (c), with immediate effect, to close all trading Accounts of such client with us, nullify all trades carried out in such client’s trading Accounts with us and cancel and all profits or losses garnered in such client’s trading Accounts with us.

Furthermorethe provisions of clause 13.11 below, in the event that we detect the Company detects any form of abuse, fraud, manipulation, cash-back “interest / cash back, arbitrage, carry trades, ” or any other forms form of deceitful or fraudulent activity in regard to any Swap-free Account of any clientFree Account, we reserve the rightCompany reserves the right to proceed with the following actions, at any time, without notice to the Client: (a) with immediate effect, to revoke Revoke the Swap-free status Free conditions from any and all real trading Accounts of such client that have been converted to a Swap-free trading Account; the Client’s account(s) (b) to correct and recover Charge any un- accrued Swaps uncharged swaps and any related un-accrued uncharged interest expenses and/or costs pertaining to any and all of such client’s Swap-free trading Accounts during Free Account(s) (c) Cancel all generated profits from the period for which such Accounts were converted into Swap-free trading Accounts; and/or Free Account(s) (c), d) Close all account(s) that the Client holds with immediate effect, to close all trading Accounts of such client with us, the Company and nullify all trades carried out positions and profits in the Swap-Free Account(s) 5.7 Hedging positions in Swap-Free Account(s) is forbidden. In such client’s trading an event, the hedged positions will be closed and swaps will be applied retroactively. 5.8 All open positions in a Swap-Free Accounts with us may be closed by the Company every Friday, an hour before the market is closed and cancel and all profits or losses garnered in such client’s trading Accounts with usmay be opened again by the Client. 5.9 All the other provisions of this Agreement shall apply to the Swap-Free Account(s).

Conversion of a real trading Account to a Swap-free an Islamic trading account is performed by our Back-Office Department only upon the request and consent of those clients customers who complete and submit a request for an Islamic (Swap-free) Account. Upon the receipt of such a duly signed and executed request, we shall evaluate request and any ancillary documentation submitted to us and shall inform the client customer who equested requested the conversion by e-mail whether the request is accepted or not. 62.2. Clients 63.3 Customers are not allowed to use Islamic (Swap-free free) Accounts to make profits from Swaps and may not request the payment of any Swap amounts that have been lost as a result of converting their real trading Account(s) into one or more Swap-free Islamic Account(s) for the period during which their real trading Account(s) has/have been converted into one or more Swap-free Islamic account(s). 62.3. 63.4 We reserve the right to revoke the Swap-free Islamic status granted to any real trading Account at any time without being obliged to provide any explanation or justification. Furthermore, in the event that we detect any form of abuse, fraud, manipulation, cash-back arbitrage, carry trades, or other forms of deceitful or fraudulent activity in regard to any Swap-free Islamic Account of any clientcustomer, we reserve the right, at any time, (a) with immediate effect, to revoke the Swap-free Islamic status from any and all real trading Accounts of such client customer that have been converted to a Swap-free Islamic trading Account; (b) to correct and recover any un- un-accrued Swaps and any related un-accrued interest expenses and/or and or costs pertaining to any and all of such clientcustomer’s Swap-free Islamic trading Accounts during the period for which such Accounts were converted into Swap-free Islamic trading Accounts; and/or (c), with immediate effect, to close all trading Accounts of such client customer with us, nullify all trades carried out in such clientcustomer’s trading Accounts with us and cancel and all profits or losses garnered in such clientcustomer’s trading Accounts with us. 63.5 Trading positions of Islamic (Swap-free) Accounts are closed automatically after 14 days of being opened.
