Common use of ISPS Code Clause in Contracts

ISPS Code. The Borrower shall, and shall procure that the Manager shall, at all times after the Delivery Date of a Vessel: (a) comply and be responsible for compliance by itself and by such Vessel with the ISPS Code; (b) ensure that: (i) the Vessel has a valid International Ship Security Certificate; (ii) the Vessel’s security system and its associated security equipment comply with section 19.1 of Part A of the ISPS Code; (iii) the Vessel’s security system and its associated security equipment comply in all respects with the applicable requirements of Chapter XI-2 of SOLAS and Part A of the ISPS Code; and (iv) an approved ship security plan is in place.

ISPS Code. The Borrower shall, and shall procure that the Manager shall, at all times after the Delivery Date of a VesselApplicable Time: (a) comply and be responsible for compliance by itself and by such each Secured Vessel with the ISPS Code; (b) ensure that: (i) the each Secured Vessel has a valid International Ship Security Certificate; (ii) the each Secured Vessel’s security system and its associated security equipment comply with section 19.1 of Part A of the ISPS Code; (iii) the each Secured Vessel’s security system and its associated security equipment comply in all respects with the applicable requirements of Chapter XI-2 of SOLAS and Part A of the ISPS Code; and (iv) an approved ship security plan is in place.

The Borrower shallwill, and shall procure that the relevant Guarantor and the Manager shall, at all times after the Delivery Date of a Vessel: (a) comply and be responsible for compliance by itself and by such Guarantor’s Vessel with the ISPS Code; (b) ensure that: (i) the such Vessel has a valid International Ship Security Certificate; (ii) the such Vessel’s security system and its associated security equipment comply with section 19.1 of Part A of the ISPS Code; (iii) the such Vessel’s security system and its associated security equipment comply in all respects with the applicable requirements of Chapter XI-2 of SOLAS and Part A of the ISPS Code; and (iv) an approved ship security plan is in place.

The Each Borrower shall (and the Guarantor will procure that each Borrower shall), and shall procure that the Manager Manager, the Owners and the Bareboat Charterer shall, at all times after the Delivery Date of a Vessel: (a) comply and be responsible for compliance by itself and by such Vessel with the ISPS Code; (b) ensure that: (i) the Vessel has a valid International Ship Security Certificate; (ii) the Vessel’s security system and its associated security equipment comply with section 19.1 of Part A of the ISPS Code; (iii) the Vessel’s security system and its associated security equipment comply in all respects with the applicable requirements of Chapter XI-2 of SOLAS and Part A of the ISPS Code; and (iv) an approved ship security plan is in place.
