JAMS and JAMS Streamlined Arbitration Rules. The Arbitration shall be administered by JAMS. In the event that JAMS no longer exists or if JAMS fails or refuses to accept submission of such dispute, then the Arbitration shall be administered by the AAA in Westlake, California. Regardless of the alternative dispute resolution provider used (i.e., either JAMS or AAA), the Arbitration shall be administered and conducted pursuant to the JAMS Streamlined Arbitration Rules & Procedures (the "Rules"), effective March 26, 2007. Even if the Rules have been amended as of the date of the commencement of an Arbitration, the version dated March 26, 2007 shall be used; provided, however, that the following modifications shall take precedence over the Rules:
