JDSU ESPP. The administrator of the JDSU ESPP shall take all actions necessary and appropriate to provide that: (i) eligible JDSU Group Employees and eligible Lumentum Group Employees may participate in any offering and purchase periods ending prior to the Distribution Date; (ii) Lumentum Group Employees will not be eligible to participate in any offering or purchase period under the Viavi ESPP commencing on or after the Distribution Date; and (iii) the JDSU ESPP shall continue in effect as the Viavi ESPP following the Effective Time.
