Common use of JLMC Powers Clause in Contracts

JLMC Powers. (a) The JLMC shall have the power to require payment of liquidated damages, direct the suspension of this Agreement as to any party found to be in violation of any provision of this Agreement or impose other conditions on any party to this Agreement for a violation of this Agreement, unless the violation was caused by reason(s) beyond the control of the person(s) found to be in violation. (a) Any worker who is alleged to have violated the prohibitions against contracting out under this Agreement shall be subject to the enforcement procedures of the JLMC on the same grounds as an Employer.

(a) The JLMC shall have the power to levy a fine and require payment of liquidated damages, direct the suspension of this Agreement as to any party found to be in violation of any provision of this Agreement or impose other conditions on any party to this Agreement for a violation of this Agreement, unless the violation was caused by reason(s) beyond the control of the person(s) found to be in violation. If found guilty all the legal fees shall be paid by the party in violation. (a) Any worker who is alleged to have violated the prohibitions against contracting out under this Agreement shall be subject to the enforcement procedures of the JLMC on the same grounds as an Employer.
