Common use of JPA Agreement Clause in Contracts

JPA Agreement. The purpose of the JPA Agreement is to create the Library JPA as a distinct public entity, separate and apart from the Members, pursuant to the provisions of the JPA Act (Government Code section 6506) and Education Code sections 19100, et seq. It is the intent of the Members that, under this Agreement, the Library continue as a distinct public entity under the JPA Act and other applicable law. Pursuant to Government Code section 6508.1, the debts, liabilities, or obligations of the Library JPA shall not be debts, liabilities, or obligations of the individual Members to this Agreement, unless the governing body of a Member expressly agrees in writing to assume any of the debts, liabilities, or obligations of the Library JPA.
