Judgment Creditor Clause Samples
The 'Judgment Creditor' clause defines the party who has obtained a court judgment for a monetary award and is legally entitled to collect the specified amount from the judgment debtor. In practice, this clause identifies the creditor by name or reference and may outline the rights and remedies available to them for enforcing the judgment, such as garnishing wages or seizing assets. Its core function is to clearly establish who holds the right to collect on a judgment, thereby preventing disputes over enforcement and ensuring the proper party is recognized in legal proceedings.
Judgment Creditor. A judgment creditor or judgment creditors of a Borrower Group Member shall obtain possession by any lawful means of any of its assets in excess of $500,000.00 in the aggregate by any means including, without limitation, levy, restraint, or replevin.
Judgment Creditor. A judgment creditor or judgment creditors of any of the Borrowers or the Guarantors shall obtain possession of any of it or his assets in excess of $50,000.00 in the aggregate by any means including, without limitation, levy, restraint, or replevin; provided that if any such event occurs, it shall not be an Event of Default hereunder if the Borrowers and/or Guarantors, as the case may be, diligently seeks to dissolve and/or discharge such taking and such taking is in fact dissolved and/or discharged within ninety (90) days.
Judgment Creditor. The Company shall have paid, satisfied or settled all matters related to the action filed in Nevada District Court, ▇▇▇▇▇ County on August 7, 2007 captioned Benchmark Capital, LLC vs. Forex365, Inc., formerly known as Solar Group, Inc., ▇▇▇▇ ▇▇▇▇▇▇▇▇▇ and Does I-XV including, without limitation, the default judgment filed against the Company in such matter on October 31, 2007, all on terms and conditions acceptable to the Buyer.
