Common use of Judgments and Litigation Clause in Contracts

Judgments and Litigation. There is no pending or threatened claim, audit, investigation, action or other legal proceeding or judgment or order of any court, agency or other governmental authority or arbitrator which involves Debtor or the Collateral and which might have a material adverse effect upon the Collateral, the Debtor, its business, operations, affairs or condition (financial or otherwise), or threaten the validity of this Agreement or any related document or action. Debtor will immediately notify Secured Party upon acquiring knowledge of the foregoing.

Judgments and Litigation. There is no pending or threatened claim, audit, investigation, action or other legal proceeding or judgment judgment, order or order award of any court, agency or other governmental authority or arbitrator (any, an “Action”) which involves Debtor the Borrower, its Subsidiaries or the Collateral their respective assets and which might have a material adverse effect upon the Collateral, the Debtor, its business, operations, affairs Borrower or condition (financial or otherwise), any Subsidiary or threaten the validity of this Agreement the Credit, any Transaction Document or any related document or action. Debtor Borrower will immediately notify Secured Party the Bank in writing upon acquiring knowledge of the foregoingany such Action.

Judgments and Litigation. There is no pending or threatened claim, audit, investigation, action or other legal proceeding or judgment judgment, order or order award of any court, agency or other governmental authority or arbitrator (each an “Action”) which involves Debtor Borrower or the Collateral its assets and which might have a material adverse effect upon the Collateral, the Debtor, its business, operations, affairs or condition (financial or otherwise), Borrower or threaten the validity of this Agreement Note or any related document or actiontransaction. Debtor Xxxxxxxx will immediately notify Secured Party the Bank in writing upon acquiring knowledge of the foregoingany such Action.
