Common use of Judicial Procedure Clause in Contracts

Judicial Procedure. Nothing in Section 12.3 shall be construed to prevent any Party from seeking from a court a temporary restraining order or other temporary or preliminary relief to preserve the status quo pending final resolution of a dispute, controversy or claim pursuant to Section 12.3, or if such Party makes a good faith determination that a breach of the terms of this Agreement by another Party is such that a temporary restraining order or other temporary or preliminary relief is the only appropriate and adequate remedy at such time.

Judicial Procedure. Nothing in Section 12.3 9.3 shall be construed to prevent any Party from seeking from a court a temporary restraining order or other temporary or preliminary relief to preserve the status quo pending final resolution of a dispute, controversy or claim pursuant to Section 12.39.3, or if such Party makes a good faith determination that a breach of the terms of this Agreement by another Party is such that a temporary restraining order or other temporary or preliminary relief is the only appropriate and adequate remedy at such time.

Judicial Procedure. Nothing in Section 12.3 10.1 or 10.2 shall be construed to prevent any Party from seeking from a court a temporary restraining order or other temporary or preliminary injunctive or other provisional relief to preserve the status quo pending final resolution of a dispute, controversy or claim Dispute pursuant to Section 12.3such sections. In addition, nothing in this Article 10 shall be construed to prevent a Party from instituting judicial proceedings at any time to avoid the expiration of any applicable limitations period or if such Party makes to preserve a good faith determination that a breach of the terms of this Agreement by another Party is such that a temporary restraining order or superior position with respect to other temporary or preliminary relief is the only appropriate and adequate remedy at such timecreditors.
