Judicial Reference Proceedings Sample Clauses

The Judicial Reference Proceedings clause establishes a process by which disputes arising under the contract are referred to a court-appointed referee, rather than being resolved through traditional court litigation or arbitration. In practice, this means that instead of a judge or jury, a neutral referee—often a retired judge or legal expert—will hear evidence, make findings of fact, and issue recommendations or decisions, which are then subject to court approval. This clause is typically used to streamline complex cases, reduce court congestion, and provide a more efficient and specialized resolution process for contractual disputes.
