Common use of JURISDICTION AND COSTS Clause in Contracts

JURISDICTION AND COSTS. 25.1 The parties hereby consent to the jurisdiction of the Magistrate’s Court otherwise having jurisdiction under section 28 of Magistrate Court Act of 1944, as amended. Notwithstanding that such proceedings are otherwise beyond the said court’s jurisdiction; this clause shall constitute the required written consent conferring jurisdiction upon the said court pursuant to Section 45 of the Magistrate’s Court Act of 1944, as amended. 25.2 Notwithstanding anything to the contrary herein contained either party hereto shall have the right at its sole option and discretion to institute proceedings in any other court which might otherwise have jurisdiction. 25.3 All legal costs incurred either party in consequence of any default of the provisions of the Contract by the other, shall be payable by the defaulting party on demand to the maximum amount permitted by law and shall include collection charges, the cost incurred by the aggrieved party in endeavouring to enforce such rights prior to the institution of legal proceedings and the costs incurred in connection with the satisfaction or enforcement of any judgment awarded in favour of the aggrieved party in relation to, in terms of or arising out of the Contract in respect of any legal proceedings arising out of the Contract.
