Jurisdictional Issues a) The Site is solely directed to individuals residing in the United States. We make no representation that Materials available on or through the Site are appropriate or available for use in other locations. Those who choose to access the Site from other locations do so on their own initiative and at their own risk, and are responsible for compliance with local laws, if and to the extent local laws are applicable. The Software is further subject to United States export controls.

Those who choose to access or use the Site or Services do so on their own initiative and are responsible for compliance with all applicable Laws.
Jurisdictional Issues. The Site is controlled and/or operated from the United States, and is not intended to subject Company to non-U.S. jurisdiction or laws, except as otherwise expressly stated in this Agreement. IDENTIFICATION OF AN INDIAN CHILD DHS and the tribes agree that the LSSAs are required under federal and state law to determine whether a child who is at risk of out-of-home placement is an Indian child, and to identify the child=s tribe(s). DHS shall provide training and technical assistance to the LSSAs to achieve compliance with procedures set forth in ICWA, MIFPA, and the Indian Child Welfare Procedures Manual. AIndian Child@ means any unmarried person who is under age eighteen and is (a) either a member of an Indian tribe or (b) eligible for membership in an Indian tribe. (Minn. Stat. ' 257.351, subd. 6). A determination by the tribe that a child is a member or eligible for membership in the tribe is conclusive. (This shall not be construed as an amendment of present tribal enrollment policies) (See Definition 21). Note: Enrollment is the term commonly used to refer to the status of an Indian person as a part of a specific Indian tribe. However, while enrollment is the common means to establishing membership in an Indian tribe, it is not the only means. A person may have membership in a tribe without being enrolled according to criteria established by that tribe. This criteria may be established by tribal ordinance and may be unique to the tribe. A determination by the tribe that a child is a member of or eligible for membership in the tribe is conclusive.

To overcome this, the key will be stronger communication between entities.” In some cases, multiple agencies or levels of government might have joint responsibility for stormwater management. The survey therefore asked about jurisdictional issues. Some MS4s are concerned with jurisdictional issues with railroads. In two cases, railroads are reported not to take care of their inlets in their rights-of-way through MS4 areas. In addition, some MS4s are concerned with jurisdictional issues with the West Virginia Division of Highways. In particular, one MS4 in an interview expressed a concern over the lack of participation from this agency in maintaining the stormwater management systems on its roads within the MS4 area. Jurisdictional issues may also arise where MS4 and city boundaries do not overlap. In this case, it may be difficult to collect fees from areas outside of the city boundary (See Section 3.2). Finally, jurisdictional issues arise with enforcement. The MS4 program essentially envisions joint enforcement of construction sites by MS4s and WVDEP. If WVDEP does not credibly enforce the general construction stormwater permit, it can undermine local MS4 programs’ efforts to work together with other responsible parties. In addition, co-permitting has not yet been used in the state to address jurisdictional overlaps.
