Jury Trial Waiver, Class Action Waiver and Venue. This Section applies to business customers and business accounts. YOU AND WE HEREBY ABSOLUTELY, UNCONDITIONALLY, IRREVOCABLY, AND EXPRESSLY WAIVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR ACCOUNT. YOU AND WE HEREBY FURTHER AGREE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THAT SUCH CLAIM WILL BE ON AN INDIVIDUAL BASIS. YOU UNDERSTAND AND AGREE THAT YOU ARE WAIVING THE RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER IN ANY CLASS ACTION LAWSUIT. You further agree that any claim or dispute arising out of or related to this Agreement or your account must be brought in a court of competent jurisdiction located in Topeka, Shawnee County, Kansas, and that you will submit to the personal jurisdiction of such a court for the purpose of litigating all such claims or disputes.
