As of the Closing Date, Pacific Sunwear Stores Corp. does not have any “Personal Property” (as such term is defined in the Mortgage Debt Documents as in effect on the date hereof) located at the Kansas Distribution Facility. At no time after the Closing Date shall Pacific Sunwear Stores Corp. transfer any “Personal Property” (as such term is defined in the Mortgage Debt Documents as in effect on the date hereof) to, or maintain any “Personal Property” (as such term is defined in the Mortgage Debt Documents as in effect on the date hereof) at, such location, nor shall it permit any such actions to be taken by any other Person.
