BANK GMBH in its capacity as security trustee for (a) the ECF Creditors pursuant to the declaration of trust made in the ECF 2 Security Trust Deed, (b) the Jade Creditors pursuant to the declaration of trust made in the Jade Security Trust Deed and (c) the Jewel Creditors pursuant to the declaration of trust made in the Jewel Security Trust Deed (the “Collateral Agent”); and
