Common use of Knowledge of Trustee Clause in Contracts

Knowledge of Trustee. Notwithstanding any provision of this Indenture, the Trustee shall not be charged with knowledge of the existence of any facts which would prohibit the making of any payment of monies to or by the Trustee until two Business Days after the Trustee shall have received written notice thereof from the Guarantor, any Securityholder or any Paying Agent or the holder or representative of any class of Senior Indebtedness of the Guarantor.

Knowledge of Trustee. Notwithstanding any provision provisions of this Indenture, the Trustee shall not be charged with actual knowledge of the existence of any facts which would prohibit the making of any payment of monies to or by the Trustee Trustee, or the taking or not taking of any other action by the Trustee, until two Business Days after the Trustee through a Responsible Officer shall have received written notice thereof thereon from the GuarantorCompany, any Securityholder Debentureholder or any Paying Agent or the holder or representative of any class of Senior Indebtedness of the GuarantorIndebtedness.

Notwithstanding the provisions of this Article or any other provision of this Indenture, the Trustee shall not at any time be charged with knowledge of the existence of any facts which would prohibit the making of any payment of monies to or by the Trustee Trustee, or the taking of any other action under this Indenture by the Trustee, unless and until two Business Days after the Trustee shall have received written notice thereof from the GuarantorCompany, any Securityholder or Holder, any Paying Agent or the any holder or representative of any class of Senior Indebtedness of the Guarantoror its representative.
