Common use of Land Acquisition and Involuntary Resettlement Clause in Contracts

Land Acquisition and Involuntary Resettlement. The Borrower shall ensure or cause the State and the DISCOMs to ensure that all land and all rights-of-way required for each Subproject are made available to the Works contractor in accordance with the schedule agreed under the related Works contract and all land acquisition and resettlement activities are implemented in compliance with (a) all applicable laws and regulations of the Borrower relating to land acquisition and involuntary resettlement; (b) the Involuntary Resettlement Safeguards; (c) the RF; and (d) all measures and requirements set forth in the RP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.

Land Acquisition and Involuntary Resettlement. The Borrower and Pourashavas shall ensure or cause the State and the DISCOMs to ensure that all land and all rights-of-way required for the project, each Subproject and all project facilities are made available to the Works contractor in accordance with the schedule agreed under the related Works contract and all land acquisition and resettlement activities are implemented in compliance with (a) all applicable laws and regulations of the Borrower relating to land acquisition and involuntary resettlement; (b) the Involuntary Resettlement Safeguardsinvoluntary resettlement safeguards; (c) the RF; and (d) all measures and requirements set forth in the respective RP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.

The Borrower shall ensure or cause the State and the DISCOMs relevant Project Executing Agency to ensure that all land and all rights-of-way required for each Roads Subproject, and all Roads Subproject facilities are made available to the Works contractor in accordance with the schedule agreed under the related Works contract and all land acquisition and resettlement activities are implemented in compliance with (a) all applicable laws and regulations of the Borrower and the State relating to land acquisition and involuntary resettlement; (b) the Involuntary Resettlement Safeguards; (c) the RF; and (d) all measures and requirements set forth in the respective RP, and any corrective or preventative preventive actions with respect to land acquisition and involuntary resettlement set forth in a Safeguards Monitoring Report.

The Borrower shall ensure or cause the State and the DISCOMs IDCOL to ensure that all land and all rights-of-way required for each Qualified Subproject are made available to the Works contractor in accordance with the schedule agreed under the related Works contract and all land acquisition and resettlement activities are implemented in compliance with (a) all applicable laws and regulations of the Borrower relating to land acquisition and involuntary resettlement; (b) the Involuntary Resettlement Safeguards; (c) the RFESSF; and (d) all measures and requirements set forth in the respective RP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.

The Borrower shall ensure ensure, or cause the State and to ensure, that the DISCOMs to ensure relevant Project Executing Agency ensures that all land and all rights-of-way required for each Subproject are made available to the Works contractor in accordance with the schedule agreed under the related Works contract and all any land acquisition and resettlement activities are implemented in compliance with with: (a) all applicable laws and regulations of the Borrower and the State relating to land acquisition and involuntary resettlement; (b) the Involuntary Resettlement Safeguards; and (c) the RF; and (d) all measures and requirements set forth in the RP, and any corrective or preventative actions set forth in a the Safeguards Monitoring Report.

The Borrower shall ensure ensure, or cause the State EA to ensure, that PHED and the DISCOMs to ensure that LSGD make all land and all rights-of-way required for each Subproject are made subproject available to the Works contractor in accordance with the schedule agreed under the related Works contract contract, and all land acquisition and resettlement activities are implemented in compliance with (a) all applicable laws and regulations of the Borrower and the State relating to land acquisition and involuntary resettlement; (b) the Involuntary Resettlement Safeguards; (c) the RF; and (d) all measures and requirements set forth in the RP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
