Common use of Landlord’s Election Clause in Contracts

Landlord’s Election. At any time within five (5) business days after Landlord's receipt of the information specified in Subsection 15(c), Landlord may, by written notice to Tenant, elect either (i) to consent to the sublet by Tenant; or (ii) to refuse its consent to the sublet. If Landlord fails to elect either of the alternatives within the five (5) business day period, it shall be deemed that Landlord has refused its consent to the sublet. If Landlord refuses its consent, Landlord shall deliver to Tenant a statement of the basis for its refusal. Any attempted sublet without Landlord's consent shall not be effective.
