Landlord’s Obligation. (1) Subject to the provisions of Article Eight (Damage or Destruction) and Article Nine (Condemnation) and except for damage caused by any act or omission of Tenant, Landlord shall keep the roof, skylights, foundation, structural components and the structural portions of exterior walls of the Demised Premises in good order, condition and repair. Landlord shall not be obligated except as otherwise provided in this lease, to maintain or repair windows, doors, overhead doors, plate glass or the surfaces of walls. In addition, Landlord shall not be obligated to make any repairs under this Section until a reasonable time after receipt of written notice from Tenant of the need for repairs. If any repairs are required to be made by Landlord, Tenant shall, at Tenant's sole cost and expense, promptly remove Tenant's furnishings, fixtures, inventory, equipment and other property, to the extent required to enable Landlord to make repairs. Landlord's liability under this Section shall be limited to the cost of those repairs or corrections. Tenant waives the benefit of any present or future law which might give Tenant the right to repair the Demised Premises at Landlord's expense or to terminate the Lease because of the condition. (2) All repair, maintenance, management and other services to be performed by Landlord or Landlord's agents involve the exercise of professional judgment by service providers, and Tenant expressly waives any claim for breach of warranty arising from the performance of those services.

Landlord’s Obligation. (1) Subject to the provisions of Article Eight (Damage or Destruction) and Article Nine (Condemnation) and except for damage caused by any act or omission of Tenant, Landlord shall keep maintain and repair the roof, skylights, foundation, structural components Project-wide systems and the structural portions of the Project including, without limitation, the foundation, floor/ceiling slabs, roof, curtain wall, exterior walls of the Demised Premises in good orderglass, condition columns, beams, shafts, stairs, stairwells and repaircommon areas. Landlord shall not be obligated except as otherwise provided in this lease, to maintain or also repair windows, doors, overhead doors, plate glass or the surfaces of walls. In addition, Landlord shall not be obligated to make any repairs under this Section until a reasonable time after receipt of written notice from Tenant of the need for repairs. If any repairs are required to be made by Landlord, Tenant shall, at Tenant's its sole cost and expense, promptly remove any latent defects in the design or construction of the Project or Development Common Areas, any defects in the Improvements which constitute a breach of the one-year construction warranty provided by the Contractor who installs the Improvements or are not installed in accordance with the approved drawings, plans and specifications. Landlord shall, at no cost to Tenant's furnishings, fixturesmake such modifications, inventory, equipment repairs and other property, upgrades to the extent required Project and Development Common Areas as are necessary to enable comply with disability, life, seismic, fire and safety codes, ordinances, statutes, or any other applicable Laws in effect on or prior to the Commencement Date, including, without limitation, then current requirements of the Americans with Disabilities Act. Notwithstanding any provision set forth in this Article 9 to the contrary, if Tenant provides written notice to Landlord of an event or circumstance which requires the action of Landlord with respect to make repairs. repair and/or maintenance of the Premises only (and not any other portion of the Project), and Landlord fails to provide such action within thirty (30) days after Landlord's liability under this Section shall be limited to the cost receipt of those repairs or corrections. Tenant waives the benefit of any present or future law which might give Tenant the right to repair the Demised Premises at Landlord's expense or to terminate the Lease because of the condition.
