Common use of Landlord’s Retention of Contractor Clause in Contracts

Landlord’s Retention of Contractor. Landlord shall independently retain Contractor, on behalf of Tenant, to construct the Improvements in accordance with the Approved Working Drawings and the Cost Proposal and Landlord shall coordinate the construction by Contractor, and Tenant shall pay a construction coordination fee (the “Landlord Coordination Fee”) to Landlord in an amount equal to the product of (i) three percent (3%) and (ii) an amount equal to the Improvement Allowance plus the Over-Allowance Amount (as such Over-Allowance Amount may increase pursuant to the terms of this Tenant Work Letter).

Landlord shall independently retain Contractor, on behalf of Tenant, to construct the Tenant Improvements in accordance with the Approved Working Drawings and the Cost Proposal and Landlord shall coordinate supervise the construction by Contractor, and Tenant shall pay a construction coordination supervision and management fee (the “Landlord Coordination Supervision Fee”) to Landlord in an amount equal to the product of (i) three four percent (34%) and (ii) an amount equal to the Tenant Improvement Allowance plus the Over-Allowance Amount (as such Over-Allowance Amount may increase pursuant to the terms of this Tenant Work Letter).

Landlord shall independently retain Contractor, on behalf of Tenant, Contractor to construct the Improvements in accordance with the Approved Working Drawings and the Cost Proposal and Landlord shall coordinate supervise the construction by Contractor, and Tenant shall pay a construction coordination supervision and management fee (the “Landlord Coordination Supervision Fee”) to Landlord in an amount equal to the product of (i) three five percent (35%) and multiplied by (ii) an amount equal the total aggregate costs incurred by Tenant and Landlord to design and construct the Improvement Allowance plus Improvements (including the Over-Allowance Amount (Amount, if any, as such Over-Allowance Amount may increase pursuant to the terms of this Tenant Work Letter).

Landlord’s Retention of Contractor. Landlord shall independently retain Contractor, on behalf of Tenant, Contractor to construct the Improvements in accordance with the Approved Working Drawings and the Cost Proposal and Landlord shall coordinate supervise the construction by Contractor, and Tenant shall pay a construction coordination supervision and management fee (the “Landlord Coordination Supervision Fee”) to Landlord in an amount equal to the product of (i) three percent (3%) and (ii) an amount equal to the Improvement Allowance (to the extent fully utilized) plus the Over-Allowance Amount Amount, if any (as such Over-Allowance Amount may increase pursuant to the terms of this Tenant Work Letter), provided that in no event shall the Landlord Supervision Fee exceed One Hundred Thousand Dollars ($100,000.00).

Landlord shall independently retain Contractor, on behalf of Tenant, to construct the Expansion Improvements in accordance with the Approved Working Drawings and the Cost Proposal and Landlord shall coordinate supervise the construction by Contractor, and Tenant shall pay a construction coordination supervision and management fee (the “"Landlord Coordination Supervision Fee”") to Landlord in an amount equal to the product of (i) three five percent (35%) and (ii) an amount equal to the Expansion Improvement Allowance plus the Over-Allowance Amount (as such Over-Allowance Amount may increase pursuant to the terms of this Tenant Work Letterletter).

Landlord shall independently retain Contractor, on behalf of Tenant, Contractor to construct the Tenant Improvements in accordance with the Approved Working Drawings and the Cost Proposal and Landlord shall coordinate supervise the construction by Contractor, and Tenant shall pay a construction coordination supervision and management fee (the “Landlord Coordination Supervision Fee”) to Landlord in an amount equal to the product of (i) three percent (3%) and (ii) an amount equal to the Tenant Improvement Allowance plus the Over-Allowance Amount (as such Over-Allowance Amount may increase pursuant to the terms of this Tenant Work Letter), provided that the Landlord Supervision Fee shall not exceed Forty-One Thousand Dollars ($41,000).

Landlord shall independently retain Contractor, on behalf of Tenant, to construct the Improvements in accordance with the Approved Working Drawings and the Cost Proposal and Landlord shall coordinate the construction by Contractor, and Tenant shall pay a construction coordination fee (the “"Landlord Coordination Fee”") to Landlord in an amount equal to the product of (i) three five percent (35%) and (ii) an amount equal to the Improvement Allowance plus the Over-Allowance Amount (as such Over-Allowance Amount may increase pursuant to the terms of this Tenant Work Letter)) or if not all of the Improvement Allowance is used, an amount equal to the Improvement Allowance minus the unused amount thereof.
