Common use of Late Sign-Up Clause in Contracts

Late Sign-Up. In cases where Traders wish to become Members during a period of Accreditation, in order to enable Eco-mobilier to verify that the new Member has fulfilled their obligations before becoming an Eco- mobilier Member, the applicant must provide Eco-mobilier with their Unique Identifier and evidence that, prior to membership, they had operated their own collection system accredited under the French Environmental Code, or that they belonged to another Accredited Organisation. Failing this, the Trader will be considered to have signed up belatedly (hereinafter referred to as "Late Sign-Up"). In cases of Late Sign-Up, signing the Contract implies acceptance of retroactive Eco-fees for all TOYS sold as of the date on which the Eco-fees became applicable, within the limit of the date on which the Contracting Party became a Trader, and for the months between 1st January of the year during which the Contract was signed and the date of signature, within the Geographical Scope of Application of the Accreditation. As such, new Members signing up belatedly to the scheme will have a period of twenty-one (21) calendar days following the signature of the Contract during which they must declare the quantity of TOYS they have sold as of the date on which the Eco-fees became applicable, and, if the Contract is signed during the course of the year, during the period between 1st January of the current year and the date of signature, in accordance with Articles 4 and 6.2 of the Contract. These Eco-fees shall be calculated using the Pricing Scale in force as of the date on which the fees were incurred.
