LAWFUL POSSESSION. Each PARTY represents that to the best of its knowledge and belief, it will be in the lawful possession of any CONFIDENTIAL INFORMATION when disclosed by it pursuant to the AGREEMENT and that the disclosure of said CONFIDENTIAL INFORMATION shall not in any way violate any agreement to hold such CONFIDENTIAL INFORMATION in confidence.
