LAYOFF FOR LACK OF FUNDS. 24.1 The District may lay off unit members pursuant to the provisions of Education Code Section 44955 any time the District determines there is a lack of funds, provided the statutory timeline for notice governing such layoffs in Education Code Section 44949 will be changed from March 15 to May 15, with the other dates set back appropriately. 24.2 The above provision shall not be construed in any manner as a limitation upon the right of the District to reduce or eliminate services or to lay off unit members, as such rights existed under the Education Code at the time of execution of this Agreement; nor shall such provision be construed to limit the rights of the District as set forth in Article 5 of this Agreement. 24.3 Any dispute arising under this provision shall not be subject to the grievance/arbitration mechanism. Enforcement of rights hereunder shall be as provided by law.
