Lease and Purchase Agreement. Concurrently with the execution of this Memorandum, Lessor and Xxxxxx have executed that certain Lease Purchase Agreement dated as of the date hereof, wherein (i) Lessee will continue to lease the Property from Lessor, and wherein Lessor has agreed to sell the Property to Lessee, and (ii) Lessee has agreed to purchase the Property from Lessor, all upon the terms and conditions set forth therein (the “Lease Purchase Agreement”).
