LEGAL ACTION MUST BE BROUGHT WITHIN. ONE YEAR. All legal action (including arbitration) between Merchant and Bank or Company must be commenced within one (1) year of the date the error or incident giving rise to such action occurred. OTHERWISE SUCH ACTION IS PERMANENTLY BARRED.
