DESIRING to create a common aviation area (CAA) based on mutual market access to the air transport markets of the Parties, with equal conditions of competition and respect for the same rules β including in the areas of safety, security, air traffic management, social harmonisation and the environment; RECOGNISING the integrated character of international civil aviation and the rights and obligations of Ukraine and the EU Party"Member States stemming from their membership of international aviation organisations, in particular the International Civil Aviation Organisation (ICAO) and the European Organisation for the Safety of Air Navigation, as well as their rights and obligations under international agreements with third parties and international organisations; DESIRING to deepen relations between the Parties in the field of air transport, including in the area of industrial cooperation, and THE SOCIALIST REPUBLIC OF VIET NAM to build upon the framework of the other partexisting system of air services agreements in order to promote economic, hereinafter referred to as "Viet Nam", hereinafter jointly referred to as the "Parties", RECOGNISING their longstanding cultural and strong partnership based on the common principles and values reflected in the Framework Agreement on Comprehensive Partnership and Cooperation transport links between the European Union and its Member States, Parties; DESIRING to facilitate the expansion of the one part, and the Socialist Republic of Viet Nam, of the other part, signed in Brussels on 27 June 2012 (hereinafter referred to as the "Partnership and Cooperation Agreement"), and their important economic, trade and investment relationshipair transport opportunities, including as reflected through the development of air transport networks in order to meet the Free Trade needs of passengers and shippers for convenient air transport services; RECOGNISING the importance of air transport in promoting trade, tourism and investment; NOTING the Convention on International Civil Aviation, opened for signature at Chicago on 7 December 1944; BEARING IN MIND that the Association Agreement between the European Union and the Socialist Republic European Atomic Energy Community and their Member States and Ukraine provides that, with a view to assuring a coordinated development of Viet Namtransport between the Parties adapted to their commercial needs, signed the conditions of mutual market access and provision of services in Brussels on dd/mm/yyyy (hereinafter referred to as the "Free Trade Agreement")air transport may be dealt with by specific agreements; DESIRING to further strengthen their economic relationship as part of, make it possible for air carriers to offer passengers and shippers competitive prices and services in a manner coherent with, their overall relations, and convinced that this Agreement will create a new climate for the development of investment between the Parties; EU/VN/IPA/en 4 RECOGNISING that this Agreement will complement and promote regional economic integration efforts; DETERMINED to strengthen their economic, trade and investment relationship in accordance with the objective of sustainable development, in its economic, social and environmental dimensions, and to promote investment under this Agreement in a manner mindful of high levels of environmental and labour protection and relevant internationally recognised standards and agreements to which they are partyopen markets; DESIRING to raise living standardshave all sectors of the air transport industry, promote economic growth including air carrier workers, benefit from a liberalised agreement; INTENDING to build upon the framework of existing air transport agreements with the goal of gradually opening access to markets and stabilitymaximising benefits for the consumers, create new employment opportunities air carriers, workers and improve communities of both Parties; AGREEING that it is appropriate to base the general welfare andCAA rules on the relevant legislation within the European Union, as laid down in Annex I to this endAgreement, without prejudice to the EU Treaties and the Constitution of Ukraine; NOTING the intention of Ukraine to incorporate into its aviation legislation the corresponding requirements and standards of the European Union, including with regard to future legislative developments within the EU; DESIRING to ensure the highest degree of safety and security in international air transport and reaffirming their commitment grave concern with regard to promoting investment; REAFFIRMING their commitments to acts or threats against the principles security of sustainable development aircraft which jeopardise the safety of persons or property, adversely affect the operation of aircraft and undermine the confidence of the travelling public in the Free Trade Agreementsafety of civil aviation; RECOGNISING the benefits that both Parties can reap from full compliance with the CAA rules, including the opening of access to markets and the maximisation of benefits for the consumers and the industries of both Parties; RECOGNISING that the creation of the CAA and implementation of its rules cannot be achieved without transitional arrangements and that adequate assistance is important in this perspective; EMPHASISING that air carriers should be treated in a transparent and non-discriminatory manner regarding their access to air transport infrastructures, especially where these infrastructures are limited, including access to airports; DESIRING to ensure a level playing field for air carriers, allowing fair and equal opportunity for their air carriers to operate the agreed services; RECOGNISING that government subsidies may adversely affect air carrier competition and may jeopardise the basic objectives of this Agreement; AFFIRMING the importance of transparency as reflected protecting the environment in their commitments in developing and implementing international aviation policy and recognising the Free Trade Agreementrights of sovereign States to take appropriate measures to this effect; REAFFIRMING their commitment to NOTING the Charter importance of protecting consumers, including the United Nationsprotections afforded by the Convention for the Unification of Certain Rules for International Carriage by Air, done at San Francisco on 26 June 1945, and having regard Montreal 28 May 1999; DESIRING to create a common aviation area (CAA) based on mutual market access to the air transport markets of the Parties, with equal conditions of competition and respect for the same rules β including in the areas of safety, security, air traffic management, social harmonisation and the environment; RECOGNISING the integrated character of international civil aviation and the rights and obligations of Ukraine and the EU Party"Member States stemming from their membership of international aviation organisations, in particular the International Civil Aviation Organisation (ICAO) and the European Organisation for the Safety of Air Navigation, as well as their rights and obligations under international agreements with third parties and international organisations; DESIRING to deepen relations between the Parties in the field of air transport, including in the area of industrial cooperation, and THE SOCIALIST REPUBLIC OF VIET NAM to build upon the framework of the other partexisting system of air services agreements in order to promote economic, hereinafter referred to as "Viet Nam", hereinafter jointly referred to as the "Parties", RECOGNISING their longstanding cultural and strong partnership based on the common principles and values reflected in the Framework Agreement on Comprehensive Partnership and Cooperation transport links between the European Union and its Member States, Parties; DESIRING to facilitate the expansion of the one part, and the Socialist Republic of Viet Nam, of the other part, signed in Brussels on 27 June 2012 (hereinafter referred to as the "Partnership and Cooperation Agreement"), and their important economic, trade and investment relationshipair transport opportunities, including as reflected through the development of air transport networks in order to meet the Free Trade needs of passengers and shippers for convenient air transport services; RECOGNISING the importance of air transport in promoting trade, tourism and investment; NOTING the Convention on International Civil Aviation, opened for signature at Chicago on 7 December 1944; BEARING IN MIND that the Association Agreement between the European Union and the Socialist Republic European Atomic Energy Community and their Member States and Ukraine provides that, with a view to assuring a coordinated development of Viet Namtransport between the Parties adapted to their commercial needs, signed the conditions of mutual market access and provision of services in Brussels on dd/mm/yyyy (hereinafter referred to as the "Free Trade Agreement")air transport may be dealt with by specific agreements; DESIRING to further strengthen their economic relationship as part of, make it possible for air carriers to offer passengers and shippers competitive prices and services in a manner coherent with, their overall relations, and convinced that this Agreement will create a new climate for the development of investment between the Parties; EU/VN/IPA/en 4 RECOGNISING that this Agreement will complement and promote regional economic integration efforts; DETERMINED to strengthen their economic, trade and investment relationship in accordance with the objective of sustainable development, in its economic, social and environmental dimensions, and to promote investment under this Agreement in a manner mindful of high levels of environmental and labour protection and relevant internationally recognised standards and agreements to which they are partyopen markets; DESIRING to raise living standardshave all sectors of the air transport industry, promote economic growth including air carrier workers, benefit from a liberalised agreement; INTENDING to build upon the framework of existing air transport agreements with the goal of gradually opening access to markets and stabilitymaximising benefits for the consumers, create new employment opportunities air carriers, workers and improve communities of both Parties; AGREEING that it is appropriate to base the general welfare andCAA rules on the relevant legislation within the European Union, as laid down in Annex I to this endAgreement, without prejudice to the EU Treaties and the Constitution of Ukraine; NOTING the intention of Ukraine to incorporate into its aviation legislation the corresponding requirements and standards of the European Union, including with regard to future legislative developments within the EU; DESIRING to ensure the highest degree of safety and security in international air transport and reaffirming their commitment grave concern with regard to promoting investment; REAFFIRMING their commitments to acts or threats against the principles security of sustainable development aircraft which jeopardise the safety of persons or property, adversely affect the operation of aircraft and undermine the confidence of the travelling public in the Free Trade Agreementsafety of civil aviation; RECOGNISING the benefits that both Parties can reap from full compliance with the CAA rules, including the opening of access to markets and the maximisation of benefits for the consumers and the industries of both Parties; RECOGNISING that the creation of the CAA and implementation of its rules cannot be achieved without transitional arrangements and that adequate assistance is important in this perspective; EMPHASISING that air carriers should be treated in a transparent and non-discriminatory manner regarding their access to air transport infrastructures, especially where these infrastructures are limited, including access to airports; DESIRING to ensure a level playing field for air carriers, allowing fair and equal opportunity for their air carriers to operate the agreed services; RECOGNISING that government subsidies may adversely affect air carrier competition and may jeopardise the basic objectives of this Agreement; AFFIRMING the importance of transparency as reflected protecting the environment in their commitments in developing and implementing international aviation policy and recognising the Free Trade Agreementrights of sovereign States to take appropriate measures to this effect; REAFFIRMING their commitment to NOTING the Charter importance of protecting consumers, including the United Nationsprotections afforded by the Convention for the Unification of Certain Rules for International Carriage by Air, done at San Francisco on 26 June 1945, and having regard Montreal 28 May 1999; WELCOMING the ongoing dialogue between the Parties to the principles articulated deepen their relations in The Universal Declaration of Human Rights, adopted by the General Assembly of the United Nations on 10 December 1948;
