Common use of Lender's Investigations Clause in Contracts

Lender's Investigations. Borrower shall be solely responsible for all aspects of Borrower’s business and activities. Any investigation or review by Lender or its counsel shall be solely for Lender’s benefit, including to determine whether Borrower is properly discharging its obligations to Lender, and may not be relied upon by Borrower or any third party. Neither Lender, nor Lender’s counsel, owes any duty of care to Borrower or to any third party to protect against, or to inform Borrower or any third party of, any matters disclosed by any investigation or review by Lender or its counsel.
