Lender’s Setoff Sample Clauses

The Lender’s Setoff clause grants the lender the right to deduct or withhold amounts owed to it by the borrower from any funds the lender holds on the borrower’s behalf, such as deposits or accounts. In practice, if the borrower defaults on a loan or fails to make a required payment, the lender can use this clause to recover the owed amount directly from the borrower’s balances held at the bank, without needing to pursue separate legal action. This clause primarily serves to protect the lender by providing a straightforward mechanism to recover debts, thereby reducing the risk of non-payment.
