Lessee’s Exercise of Rights; Acknowledgment of Lessor. Lessee may construct and install the System on the Premises in the manner Lessee deems reasonable and appropriate; provided, however, that Lessee will not unreasonably interfere with Lessor’s use, operation, or maintenance of the Premises or the Property. Nothing expressly or impliedly contained in this Agreement shall be construed to require Lessee to generate or sell any minimum or maximum amount of electrical energy from the System. Lessor acknowledges that the installation of all or a portion of the System will require physically mounting and adhering the System to the roof of the Premises, or to the ground, or a combination thereof.

  • Non-Exercise of Rights 31.1. Either Party’s failure to seek redress for violations, or to insist upon strict performance, of any condition or provision of this Agreement, or its failure to exercise any or part of any of right or remedy to which that Party is entitled under this Agreement, shall not constitute an implied waiver thereof.

No claim based on lack of knowledge of existing conditions shall be allowed unless the existing physical conditions cannot be discovered by a reasonably observant person. Any claims relating to conditions that are materially different from the Contract Documents that were not open and apparent may be adjusted as provided in this Part.
