Common use of Lessee’s Personal Property Clause in Contracts

Lessee’s Personal Property. Lessee may (and shall as provided hereinbelow), at its expense, install, affix or assemble or place on any parcels of the Land or in any of the Leased Improvements, any items of Lessee's Personal Property, and Lessee may, subject to Section 35.2 hereof and the conditions set forth below, remove the same upon the expiration or any prior termination of the Term. Lessee shall provide and maintain during the entire Term all such Lessee's Personal Property as shall be necessary in order to operate the Facility in compliance with all licensure and certification requirements, in compliance with all applicable Legal Requirements and Insurance Requirements and otherwise in accordance with customary practice in the industry for the Primary Intended Use. All of Lessee's Personal Property not removed by Lessee within seven (7) days following the expiration or earlier termination of this Lease shall be considered abandoned by Lessee and may be appropriated, sold, destroyed or otherwise disposed of by Lessor without first giving notice thereof to Lessee, without any payment to Lessee and without any obligation to Lessee to account therefor. Lessee will, at its expense, restore the Leased Property at the expiration or earlier termination of this Lease to the condition required by Section 9.1(d), including repair of all damage to the Leased Property caused by the removal of Lessee's Personal Property, whether effected by Lessee or Lessor.

Lessee’s Personal Property. Lessee may (and shall as provided hereinbelow)Lessee, at its expense, shall install, affix or affix, assemble or and place on any parcels of the Land or in any of the Leased ImprovementsProperty, any items of the Lessee's Personal Property, and Lessee may, which Lessee's Personal Property shall be subject to the security interests and liens as provided in Section 35.2 hereof and 16.8 of this Lease. Lessee shall not, without the conditions set forth below, prior written consent of Lessor (which consent may be withheld in the event Lessee is in default hereunder) remove the same upon the expiration or any prior termination of the TermLessee's Personal Property from the Leased Property. Lessee shall provide and maintain during the entire Term all such Lessee's Personal Property as shall be necessary in order to operate the Facility in compliance with all licensure and certification requirements, in compliance with all applicable Legal Requirements and Insurance Requirements and otherwise in accordance with customary practice in the industry for the Primary Intended Use. All If removal is authorized by Lessor as provided herein, all of Lessee's Personal Property not removed by Lessee within seven (7) days following the expiration or earlier termination of this Lease shall be considered abandoned by Lessee and may be appropriated, sold, destroyed or otherwise disposed of by Lessor without first giving notice thereof to Lessee, without any payment to Lessee and without any obligation to Lessee to account therefor. Lessee will, at its expense, restore the Leased Property at the expiration or earlier termination of this Lease to the condition required by Section 9.1(d), including and repair of all damage to the Leased Property caused by the removal of Lessee's Personal Property, whether effected by Lessee, Lessor, any Lessee lender, or Lessorany Lessor lender.

Lessee willshall, at its expense, restore the Leased Property at within twenty (20) days following the expiration or earlier termination of this Lease to the condition required by Section 9.1(d)Lease, including at its sole cost and expense, repair of all any damage to the Land or the Leased Property caused Improvements occasioned by the installation, maintenance or removal of Lessee's Personal Property, whether effected by Lessee and restore the Land or LessorLeased Improvements to its condition immediately prior to any such installation.
