Common use of Lessee's Remedial Action Regarding Hazardous Materials Clause in Contracts

Lessee's Remedial Action Regarding Hazardous Materials. The Lessee will promptly take, and will cause each of its Subsidiaries promptly to take, any and all necessary remedial action in connection with the presence, storage, use, disposal, transportation or Release of any Hazardous Materials on, under or about any facility in order to comply with all applicable Environmental Laws and Governmental Authorizations. In the event that the Lessee or any of its Subsidiaries undertakes any remedial action with respect to any Hazardous Materials on, under or about any facility, the Lessee or such Subsidiary will conduct and complete such remedial action in compliance with all applicable Environmental Laws, and in accordance with the policies, orders and directives of all federal, state and local governmental authorities except when, and only to the extent that, the Lessee's or such Subsidiary's liability for such presence, storage, use, disposal, transportation or discharge of any Hazardous Materials is being contested in good faith by the Lessee or such Subsidiary. Notwithstanding anything to the contrary contained in this Lease, the Lessee and its Subsidiaries may engage in the transportation of Hazardous Materials in the ordinary course of business so long as such is conducted in compliance with all applicable Environmental Laws, and all other applicable laws, policies, orders, directives and regulations.

Lessee's Remedial Action Regarding Hazardous Materials. In the event that the Lessee or any of its Subsidiaries undertakes any remedial action with respect to any Hazardous Materials on, under or about any facility, the Lessee or such Subsidiary will conduct and complete such remedial action in compliance with all applicable Environmental Laws, and in accordance with the policies, orders and directives of all federal, state and local governmental authorities except when, and only to the extent that, the Lessee's or such Subsidiary's liability for such presence, storage, use, disposal, transportation trans- portation or discharge of any Hazardous Materials is being contested in good faith by the Lessee or such Subsidiary. Notwithstanding anything to the contrary contained in this Lease, the Lessee and its Subsidiaries may engage in the transportation of Hazardous Materials in the ordinary course of business so long as such is conducted in compliance with all applicable Environmental Laws, and all other applicable laws, policies, orders, directives and regulations.
