LESSOR OCCUPANCY. 8.1 The Lessor has the right to use or occupy the Premises free of consideration for 30 (thirty) nights in each calendar year either personally or through any invitee of the Lessor, provided that - 8.1.1 the Lessor shall be obliged to give the Lessee at least 120 (one hundred and twenty) days prior written notice; 8.1.2 should the Lessor give the Lessee less than 120 (one hundred and twenty) days' notice, the use of the Premises will only be confirmed if projected occupancy is less than 85% (eighty five percent) at the time of booking; 8.1.3 a minimum of 2 (two) days' notice is required for any booking; 8.1.4 a Lessor cannot book more than 7 (seven) nights during peak period; 8.1.5 no more than 20 nights at a time will be available for use to all Lessors during the Peak and Season periods; 8.1.6 no Rental will be payable for any night for which the Lessor has given notice to use the Premises in terms of par 8.1 and the Lessor subsequently cancels the booking and such cancellation not being in writing at least 60 (sixty) days prior to the first day of intended use. 8.1.7 the Lessee shall endeavour to accommodate the Lessor or his invitee in the Premises if it is available; and 8.1.8 the Lessor and/or any invitee of the Lessor shall not be liable to pay for the use and occupation of the Premises in terms of this clause 8.1, but shall be liable to pay R125 per person per night (with an annual escalation rate equal to C.P.I.) of occupancy for the use and enjoyment of the amenities offered by the Hotel. 8.1.9 Should any VAT be payable by the Lessee on the Lessor occupancy, the Lessor will reimburse the Lessee with such amounts paid.
