Common use of Letter of Credit Beneficiary Clause in Contracts

Letter of Credit Beneficiary. The Department acknowledges and agrees that any letter of credit issued for purposes of the requirements set forth in clause (b) of the definition of Committed Investment under the Agreement shall be deemed to satisfy such requirements even though the Collateral Agent, and not Developer, is named as beneficiary thereunder.
