Common use of Letter of Credit Requests; Notices of Issuance Clause in Contracts

Letter of Credit Requests; Notices of Issuance. (a) Whenever it desires that a Letter of Credit be issued for its account, the U.S. Borrower shall give the Administrative Agent and the Issuing Bank written notice thereof prior to 1:00 P.M. (New York time) at least five Business Days’ (or such shorter period as is acceptable to the Issuing Bank) prior to the proposed date of issuance (which shall be a Business Day). Each notice shall be in the form of Exhibit C (each a “Letter of Credit Request”) and may be delivered to the Administrative Agent and the Issuing Bank by facsimile.
