Liability and Replacement. 13.3.1. In no event shall the Service Provider be relieved of its obligations under this Agreement as a result of its use of any Subcontractors and it shall at all times be responsible to Transnet for the fulfilment of its obligations under this Agreement. The Service Provider shall at all times for the Term of this Agreement remain Transnet’s sole point of contact regarding the Services, including with respect to payment. The Service Provider shall supervise the activities and performance of each Subcontractor and shall have full liability for each such Subcontractor for any act or failure to act by such Subcontractor.
