Common use of Liability for review of Documents and Drawings Clause in Contracts

Liability for review of Documents and Drawings. Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority or the Independent Engineerof any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- clause (a) above.

Liability for review of Documents and Drawings. Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority or the Independent Engineerof Monitor[s] of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Project nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- clause (a) above.

Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Concessioning Authority or the Independent Engineerof of any Project Agreement, Document Document, Design or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Trauma Centre nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Concessioning Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- Sub-clause (a) above.

Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority MPRDC or the Independent Engineerof Engineer of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Project Highway nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority MPRDC shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- Sub-clause (a) above.

Liability for review of Documents and Drawings. Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority or the Independent Engineerof Monitoring Committee of any Project Agreement, Document Report or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Diagnostic Centres nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- clause (a) above.

Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority or the Independent Engineerof Engineer of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Project nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- Sub-clause (a) above.

Except to the extent expressly provided in this Agreement: (ai) no review, comment or approval by the Authority or the Independent Engineerof Concessioning authority of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance construction and O&M of the HealthcareNetwork Project nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (bii) the Authority Concessioning authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- Sub-clause (ai) above.

Except to the extent expressly provided in this Agreement: (a) ; no review, comment or approval by the Authority or the Independent Engineerof Engineer of any Project Agreement, Document or Drawing any document submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Project Highway nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) and the Authority Authority, shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- Sub-clause (a) above.

Liability for review of Documents and Drawings. ‌ Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority or the Independent Engineerof Expert of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Project nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- Sub-clause (a) above.

Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority MPRDC or the Independent Engineerof Engineer of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Project Highway nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority MPRDC shall not be liable to the Concessionaire by reason of any review, review comment, approval, observation or inspection referred to in Sub- clause (a) above.

Except to the extent expressly provided in this Agreement: (ai) no review, comment or approval by the Concessioning Authority or the Independent Engineerof of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance construction and O&M of the HealthcareNetwork Project nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (bii) the Concessioning Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- clause Sub-clause (ai) above.

Liability for review of Documents and Drawings. Except to the extent expressly provided in this Agreement: (a) no review, comment or approval by the Authority or the Independent Engineerof DoH&FW of any Project Agreementproject agreement, Document or Drawing project plan submitted by the Concessionaire nor any observation or inspection of the constructionestablishment, operation refurbishment, upgradation n, operation, or maintenance of the HealthcareNetwork Project nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) the Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation observation, or inspection referred to in Sub- Sub-clause (a) above.

Liability for review of Documents and Drawings. Except to the extent expressly provided in this Agreement: (a) a. no review, comment or approval by the Authority or the Independent Engineerof Expert of any Project Agreement, Document or Drawing submitted by the Concessionaire nor any observation or inspection of the construction, operation or maintenance of the HealthcareNetwork Storage Facility nor the failure to review, approve, comment, observe or inspect hereunder shall relieve or absolve the Concessionaire from its obligations, duties and liabilities under this Agreement, the Applicable Laws and Applicable Permits; and (b) b. the Authority shall not be liable to the Concessionaire by reason of any review, comment, approval, observation or inspection referred to in Sub- clause (a) above.
