Common use of Liability not discharged Clause in Contracts

Liability not discharged. ‌ The Assignor's liability under this deed in respect of any of the Secured Liabilities shall not be discharged, prejudiced or affected by: (a) any security, guarantee, indemnity, remedy or other right held by, or available to, the Security Trustee that is or becomes wholly or partially illegal, void or unenforceable on any ground; (b) the Security Trustee renewing, determining, varying or increasing any facility or other transaction in any manner or concurring in, accepting or varying any compromise, arrangement or settlement, or omitting to claim or enforce payment from any other person; or (c) any other act or omission that, but for this Clause 4.1, might have discharged, or otherwise prejudiced or affected, the liability of the Assignor.
