Common use of Liability of EhvEng Clause in Contracts

Liability of EhvEng. EhvEng’s liability for any damage that may arise out of or in connection with this Agreement is limited to the maximum funding to be received hereunder by the Project Partners on the basis of amounts of eligible cost each respective Project Partner contributes to the Project as shown in the Budget Sheet, without prejudice, however, to liability for gross negligence and wilful misconduct , which shall not be limited. EhvEng cannot be held liable by any of the Project Partners for any damage caused by any of the other Project Partners or third parties involved in the Project as a consequence of implementing this Agreement and/or the Project.
