Liability of First Charter. Nothing in this Supplemental Agreement shall constitute the creation of a trust or other fiduciary relationship between First Charter and the Executive or between First Charter and the Beneficiary or any other person. First Charter shall not be considered a trustee by reason of this Supplemental Agreement.
