Common use of Liability of the Holder of Common Securities Clause in Contracts

Liability of the Holder of Common Securities. Any Holder of the Common Securities shall be liable for the debts and obligations of the Issuer Trust in the manner and to the extent set forth with respect to the Common Securityholder (as defined in the Expense Agreement) and agrees that it shall be subject to all liabilities to which the Common Securityholder may be subject, and shall make all payments that the Common Securityholder is required to make, under the terms of the Expense Agreement.

Liability of the Holder of Common Securities. Any Holder of the Common Securities shall be liable for the debts and obligations all costs, expenses or liabilities of the Issuer Trust in Trust, other than to pay to Holders of any Capital Securities the manner and amounts due to the extent set forth with respect such holders pursuant to the Common Securityholder (as defined in the Expense Agreement) and agrees that it shall be subject to all liabilities to which the Common Securityholder may be subject, and shall make all payments that the Common Securityholder is required to make, under the terms of the Expense AgreementCapital Securities, and such costs, expenses or liabilities shall constitute unsecured obligations of the Holder of the Common Securities.
