Common use of Liability of Trustee Clause in Contracts

Liability of Trustee. The Trustee shall have no liability or responsibility for any matters delegated to the Corporation hereunder or under any of the Material Contracts, and the Trustee, in relying upon the Corporation and in entering into the Material Contracts, shall be deemed to have complied with its obligations under Section 7.5 and shall be entitled to the benefit of the indemnities, limitations of liability and other protection provisions provided for herein.

Liability of Trustee. The Trustee shall have no liability or responsibility for any matters delegated to the Corporation or the Manager hereunder or under any of the Material Contracts, and the Trustee, in relying upon the Corporation or the Manager and in entering into the Material Contracts, shall be deemed to have complied with its obligations under Section 7.5 Article IX and shall be entitled to the benefit of the indemnities, limitations of liability and other protection provisions indemnity provided for hereinin Article IX.

The Trustee shall have no liability or responsibility for any matters delegated to the Corporation or the Advisor hereunder or under any of the Material Contracts, and the Trustee, in relying upon the Corporation or the Advisor and in entering into the Material Contracts, shall be deemed to have complied with its obligations under Section 7.5 8.06 and shall be entitled to the benefit of the indemnitiesindemnities provided in Sections 8.09 and 8.10, limitations and for greater certainty, the provisions of liability Section 8.08 shall apply for the benefit of the Trustee with respect to the matters designated as the Corporation's responsibility in Sections 9.01 and other protection provisions provided for herein9.

The Trustee shall have no liability or responsibility for any matters delegated to the Corporation or the Administrator hereunder or under any of the Material Contracts, and the Trustee, in relying upon the Corporation or the Administrator and in entering into the Material Contracts, shall be deemed to have complied with its obligations under Section 7.5 8.4 and shall be entitled to the benefit of the indemnities, limitations of liability indemnity provided in Sections 8.7 and other protection provisions provided for herein8.8.
