Liability to the Members and the Fund. In the performance of its duties and obligations under this Agreement and Act, the Manager shall have no fiduciary or other obligations or duties to the Fund except an implied contractual covenant of good faith and fair dealing. The Manager does not, in any way, guarantee the return of the Members’ Capital Contributions or a profit for the Members from the operations of the Fund.
